Copyrights do not enter the public domain just because the works or products they protect are no longer commercially exploited or widely available. Therefore, the copyrights of games are valid even if the games are not found on store shelves, and copying or distributing those games is a copyright infringement.

Q: Haven't the copyrights for old games (like Atari & Commodore) expired?

A: U.S. copyright laws state that copyrights owned by corporations are valid for 95 years from the date of first publication. Because video and computer games have been around a little more than three decades, the copyrights of all video and computer programs will not expire for many decades to come.

In den USA sind es also sogar 95 Jahre bis man Software frei kopieren darf

Scheinbar nicht da es nicht um Monkey 3 ging und ich weiter oben schrieb, dass es illegal sei bis der Hersteller die Spiele freigegeben hat. Natürlich könnte man sich vortrefflich darüber streiten, wie man persönlich zu der von ChrisOdaWas zitierten rechtlichen Lage - insbesonders bei abandonware - steht aber ich glaube das zweckentfremdet etwas diesen Thread

Mir ist das ganze hier äusserst Suspekt und ich beende deshalb dieses Thema mit den Hinweis auf die Regeln hier, und den darin enthaltenen Bestimmungen zu Urheberrecht, Warez und was es da sonst noch alles gibt.
